    Hi
    It's been 9 years since I filed for my Eb3. July 2002. Jan 2002 is currently being processed. Do not see it coming to July 2002 .. based on the trends so far. (may take 2 years or more for all I know)

    When I filed for my EB3 .. i worked in as a support engineer.
    Am currently a manager (not support but Web Projects). SO my previous job and current one do not have a huge overlap.


    Questions for th gurus.
    1. Do you think I should apply for EB2
    2. If yes .. how much time will it take for me to get the GC? (quicker than my 2 years to indefinite for EB3)
    3. Can I get my July 2002 priority date for my EB2.
    4. Am currently on eAD. So is my wife. Will applying in EB2 affect my EAD?

    your wife is fine, with H1 transfer there is no need to file H4 transfer. She is not out of status.

    If she had presented the new H1 approval she would have got I-94 based on that date. So just apply for her H4 extension now.

    And no issues with filing I-485

    Hi ,
    my experience with O visa is that paperwork, presentation, previous track record of the lawyer with USCIS is critical

    so in this case, absorbing the 5000 cost difference may be a good idea

    Of course you can always ask your employer if they are willing to take that hit but as you know you have a 50 % chance there at the best

    So decision is yours
    If you're confident, you always have a change to get cleared everything.

    I am not exactly in this scenario.

    In my case I moved to a different company that already revalidated my H1B before moving to the new company.

    So when they old company H1B is revoked, I say an LUD on the new company H1B. But there is no EVL RFE. And there is no soft LUD also on my I-485.

    I have a similar situation and I just asked these questions from my lawyer so I can answer somewhat. Either case, someone will correct me if I am wrong.

    1.Can I add my spouse to my GC status when PD is not current?My spouse is on H1B visa.
    Not until your PD is current or close to being current. Does she have an approved LC and I-1140, pending 485 (concurrent filing)? If she does u may have some advantages like cross-chargeability etc.


    2.If I start using EAD, is it still possible to add spouse or I should maintain valid H1 status?
    Doesnt matter as long as you maintain either H1-B or AOS(pending I-485)

    After the show down of the USCIS and all the high skilled immigrats. USCIS posted that they are withdrawing the July 2nd board. This is great news.

    I have filed my I-485, I-131, and I-765, and they reached USCIS by July 13th. According to the new board, USCIS will no long reject them.

    So what will happen from now on? What is the procedure after this?

    I guess this might be a newbie question. If someone can post some answers for me, it will be very helpful.

    I know that there are too many threads open initiating new campaigns, and asking the IV administrators to make the threads sticky. However there is something that we can demand as part of administrative reforms at USCIS, without any need for congressional relief.

    When any type of application reaches USCIS, it kinda goes into a black hole. Unless there is a decision on the application, all an applicant do is to cross the figures, and hope that the outcome will be favorable. Worst, sometimes people with later priority date get the approval, and the all a victim with pretty much straight forward case can do is self consolation.

    We all know that there is a USCIS case login page, which allows us to create a portfolio and track the case approval. But the information provided by this site is really basic (Informing the applicant that the application was received on such and such date, and its pending for processing at our processing center). Why can't we ask USCIS to improve this portal, so that an applicant can view the details of the case like FP, background check result, priority date, associated 140 status, etc. I am giving this example for a 485 application, but this service can be provided for all other types of cases like H1B, EAD, AP, 140, 485, Labor Certification, etc.

    BTW, I saw a note on immigration-law.com, and according to them its a just four (yes only four) member team which is managing their information technology at USCIS. On a lighter note, I feel like creating an Open Source software consortium which will develop the software to add in efficient case processing and better services, where USCIS can download the source code to enable faster deployment of customer services portals.

    Anyway, fun apart, I think we should start a campaign to get more meaningful information from customer portal: https://egov.uscis.gov/cris/jsps/index.jsp

    This way the case processing would be more transparent, an applicant will have more information about the case, the number of phone calls USCIS receive will go down substantially, and people like us will have much more peace of mind. I was wondering if we can come up with a case status detail page, that contains majority of info/updates we applicants want to see. It should not be difficult to compile such information. So meanwhile, when nothing much is expected from Congress on legal immigration relief, at least USCIS can provide this type of service improvement. Any ideas, criticism, pros and cons of such thing?

    The backlog is so huge that there is no "light" at the end of the tunnel

    FB immigration is capped at 480K and EB immigration at 140K. Both are backlogged.. the ratio of cases is also perhaps 3:1 or 4:1, so the bulk of those pendng 485s are likely to be family based. the EB I-485 cases are probably somewhere around 250k of that 750k...

    Also, what is a backlogged case? USCIS has been changing the definition as they see fit. At one point cases that were pending FBI namecheck were not counted in backlogs!

    2. My future greencard has been filed by Company B - recd. EAD, applied 485

    My question:
    1. Can I work on my EAD either for company A or any other company?
    2. What happens if I dont join Company B ever?

    I am not a lawyer, so make sure do discuss with a good lawyer. I am just sharing the info that I know.

    US labor laws are good that no organization can stop an employee from joining any organization/company. Even if your company made you to sign a agreement, that doesn't hold in front of the law. This law could vary little from state to state, but not to great extent.

    If you are receiving calls and emails from your employer, I would suggest, change the phone number, apartment/house, etc. and ignore him. But you should know that at 140 stage you need experience letter from employer. Make sure you can get it from your colleagues. Or you must cut a deal with your ex-employer now.

    WASHINGTON�U.S. Citizenship and Immigration Services (USCIS) today announced that it has issued two decisions from the USCIS Administrative Appeals Office (AAO) as binding precedent for the agency. These decisions will provide guidance to USCIS adjudicators and help deliver predictability to the public. AAO precedent decisions result from a collaboration between the U.S. Department of Homeland Security (DHS) and the U.S. Department of Justice (DOJ), which publishes the cases.

    "The issuance of AAO precedent decisions honors USCIS�s commitment to the clear and consistent application of the immigration laws," said USCIS Director Alejandro Mayorkas. "We are grateful for the Justice Department�s partnership in our efforts to promote predictability in immigration-benefits cases." USCIS is committed to issuing further precedent decisions going forward, given their value to the agency and the public.

    An AAO precedent decision is an immigration-appeals case that DHS, with the Attorney General�s concurrence, designates as establishing a rule for deciding future cases. Once published by DOJ, AAO precedent decisions bind all DHS personnel in the administration of the immigration laws. DOJ publishes the decisions in the bound volumes of the "Administrative Decisions Under Immigration and Nationality Laws of the United States" (I&N Dec.), which also contain the precedent decisions of the DOJ�s Board of Immigration Appeals.

    The first decision affirms USCIS�s denial of an application to adjust status to permanent residence and holds that an employment-based petition must be "valid" initially if it is to "remain valid with respect to a new job." The second decision reverses USCIS�s denial of an application to preserve residence for naturalization purposes and clarifies the definition of employment by an "American firm or corporation."
