Gurus, My place of birth is different in my passport than that of my birth certificate. I will have the place of birth changed in my passport. Could you pls tell me how difficult/messy is to have the uscis change the place of birth in my h1b petition based on my new passport. I am currently in my second year h1b. please throw light on any possible complications both serious and trifle. I dont have my h1b visa stamped yet. My GC process is going to start soon.

Yes..you can apply for AP. It is the only way you can reenter into US. I applied for my F1 (spouse) too.

BTW your F1 is not valid anymore since you showed immigration intent. You are still legal status. If you have Tuition waver/ Stipend or oncampus job...you should also apply for EAD so that you can continue to earn money.

Stick with your wifes country dates. The dates in India wont be stable for long.
I requested(May 02nd) them to approve my case using "Cross-Chargeability", since my wife was born in non-retro country. But from June 01st, my PD (India) also becomes current. I really don't know what to do now?

Every time I call USCIS to inquire if my I-140 is filled under EB2 or EB3. They ask me to ask my lawyer or employer to call. They won't tell me. I do have a copy of I-140 that states it is Eb2 (Advance degree and all) but I am concerned about what is there in USCIS system.
I cannot ask my previous enployer to call as I have left the company using AC21.
Please advise what is the solution?

I am new here and do not know the exact protocol. What does IV suggest? Shall we flood the President with Qs regarding immigration reform, specifically EB? Is this a good (direct) platform to voice our concerns?

My employer applied for my PERM and i-140 in 2005 in the EB-2 category. Both were approved.
In 2007, I left my employer to pursue an MBA, and converted my H-1B to F-1 visa. Now I am planning to return to my old employer.
I would like to know whether
a) if my employer did not revoke my i-140, is my old PERM still vaild? Can I apply for a new I-140 and a new I-485 using my old approved PERM.
b) if my employer did revoke my i-140, is my old PERM still vaid? I know I can retain the priority date, but was wondering what is the status of my old PERM?
Any help is appreciated.

Thanks for the reply. I've also got canadian immigration as a backup and my visa is valid till April 20. I was planning to go to canada and come back to US on parole but my friends advised me to wait as from march bulletin it looks like my PD for Oct 05 will become current hopefully in the next bulletin. I was told that I might put the US case in risk as you never know what could happen when you come back.
What do you guys suggest?

From my experience The people at the national center have no idea whats happening when compared to the guys at the specific centers. The national centers issues generic solutions. (Say fill a form and wait for 45 days. If after 45 days there is no answer they again send the form, etc) If you really want to know more or get proper action, the people at the specific centers will have to be contacted.
The old way to get to the specified center is back. Dont listen the messages, just press the order of the buttons and it will work.

tell them to wait :D --especially if there are kids involved ..life is bad after a divorce but it will be a hell if GC is revoked (and I agree it will ..USCIS is pretty efficient in this matter atleast -- she may get deportation letter soon as it happened to one person that I know) .. This places Family judge in quandry as parents may end up in different country etc etc

In the US, attorney ethics rules vary somewhat from state to state. In most states, you are clearly entitled to all substantive materials contained in your case file. Unless the retainer/fee agreement clearly obligates you to pay for copying costs in this circumstance, the law firm should give you the documents you want without charge.

After 12 months of toil I have finally completed the narrative and evidence that I need for an EB-1a (Extraordinary Alien) application. I ab about to complete the I-140 paperwork to go with it.
My questions is this - I have contacted a small number of Immigration attorneys who have quoted me approx $6000 for the whole process. How many of you value think that USCIS would look at my application more favourably if I used a reputed attorney rathen than putting in my own application and paperwork ?

Can someone tell me how to get to the button battery that runs the date/clock on a D70? I've had three cameras with the problem of having to reset the date because the clock battery was low and the screen flashes 0 on the frame counter, the camera is virtually disabled. We have had these cameras since the fall of 2004 and they all crashed within a week of each other. I read in the book that the clock battery feeds off of the battery pack, or can be charged up (three days) with the optional ac adapter.
Also we had a problem with dust on the circuitry, dark spots showing up on images, and I had to send it to Nikon. If I need to clean that again in the future, I don't want to fry the circuitry, so any advice about that is greatly welcomed. Thank you

I like the colors, and the silhouetted person. Personally, I think cropping out a lot of the top (roughly the upper 1/2 of the picture) would make it more interesting. This would also give it a panorama-like appearance.

I am getting ready to apply for PIO for our new born (born in US) but one of my friend mentioned about applying for OCI instead.
The information on eligiblity for OCI in the NewYork consulate website is little confusing. My question is since me and my wife hold Indian passports, would my new born be eligible for OCI?
Also is there something called CIO (Not Chief Information Officer)?
